Town considers expanding its power to take property

The Town Council was evenly split, five to five, Monday night on whether or not have a public hearing on a proposed Town Code revision that would increase the town’s power to acquire private property through eminent domain. Mayor John Harkins, in his role as breaker of council tie votes, voted in favor of moving the proposal to the Ordinance Committee for a public hearing.

The proposal will get a public hearing on Jan. 26 before being routed back to the full Town Council for possible action later. If the mayor had voted no, the proposal would have died.

Currently, the Town Code on eminent domain reads: “Within the territorial limits of the Town of Stratford, no real property may be acquired by eminent domain for economic development purposes … if the resulting project will be privately owned or controlled.”

The proposed change, sponsored by Councilman Jason Santi (D-4th) and written by Town Attorney Tim Bishop, says “Within the territorial limits of the Town of Stratford, no real property may be acquired by eminent domain for economic development purposes unless the Town Council shall determine that it is in the best interest of the Town to do so and that some public improvement results from such acquisition.”

The proposed change also says that property lawfully acquired by the town through eminent domain for typical public purposes, such as sewers, roads, and flood control, may be held or controlled not only by the town, as the code reads now, but also by “some other government entity.”

According to Bishop, other government entities that might someday have control of land acquired through the town’s eminent domain conceivably could be a non-town water pollution control authority or the state of Connecticut.

This proposed change to code did not work its way through a Town Council committee, as many local law changes do. Santi, who agreed to be the sponsor of the divisive proposal, said during Monday’s Council meeting that this “is not to take Grandma’s house.”

Santi said the proposed expansion of the town’s power to take property is intended to be “very limited in scope” and help the town deal with contaminated properties or possibly blighted properties like Ross and Roberts on West Broad Street.

During a break in Monday’s Council meeting Santi acknowledged that some members of the public may fear that, although a law may be intended to be limited, it might allow the town to go beyond the limits that the originators had in mind.

Harkins said after the meeting that his vote was “to get it to the public.”

Councilmen voting against further consideration of the eminent domain power expansion were Stephanie Philips, Matt Catalano, Joe Kubic, Ken Poisson, and Paul Hoydick.

Councilmen voting in favor of keeping the eminent domain proposal alive and moving it for public hearing were: Peter Massey, Santi, Brian Dempsey, Gavin Forrester, and Jim Connor.

A proposal to change the town’s eminent domain ordinance to allow the town to acquire property for the purpose of economic development when the project would end up under the control of a private entity will be the subject of a public hearing Monday, Jan. 26, at 7 p.m. at town hall.

Also on the agenda for a public hearing on Monday are proposed ordinance changes regarding the operation of body piercing and tattoo shops and regarding time limits of parking in residential zones.

The hearing will be conducted by the Town Council’s Ordinance Committee, which is chaired by Ken Poisson (R-6th).

Twenty-one Stratford residents spoke against expanding the town’s eminent domain power, and no one spoke in favor of it.

Eight town council members voted as members of the Ordinance Committee against the eminent domain power expansion, and not one voted for it.

With that committee vote, a council proposal to allow the town to take property by eminent domain for the purpose of private development was killed. It will see no further action.

The Ordinance Committee meeting was held at 7 p.m. Monday night during a town state of emergency, two hours before cars were to be off all roads in the state by order of Gov. Dannel Malloy, and immediately following a relatively strong uproar registered by email and comments on this website expressing unhappiness with the fact that the meeting was not postponed due to weather.

At the outset of the public hearing Ordinance Committee Chairman and 6th District Councilman Ken Poisson drew applause when he announced to the crowd of almost 60 townspeople that the committee intended to reject the eminent domain proposal. Still the people wanted to be heard.

Town Attorney Tim Bishop told The Star, “My research shows that a municipality does not have the power to surrender its essential government functions such as taxation, public safety, eminent domain, etc. That means that the (current) ordinance is completely invalid, and any amendment to it would also be invalid. The end result is that in Stratford, just like anywhere else in the state, private property can be taken by eminent domain for economic development purposes.”

“Towns do not have the authority to relinquish that power,” Bishop said.

So that if state law allows towns to take property by eminent domain for private development, Devitt argues that a town may say that it can take private property but be more strict and limit the power only for certain public benefits.

Town selling land to water authority on agenda Thursday

The Planning Commission meeting to review, discuss and possibly vote on a proposal for the Town of Stratford to sell land on which the Water Pollution Control facilities are situated will be held on Jan. 29, at 6 p.m. at Town Hall.

Townspeople have a chance to learn formally about a proposal that would allow the town to sell either to either a regional water pollution control authority or to the Stratford Water Pollution Control Authority.
